These terms govern your use of fez schedule ("the Service"), operated by fez schedule ("we", "us"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.
fez schedule is a web application for scheduling hourly employees at small businesses. The Service is provided on an "as is" and "as available" basis. We may add, change, or remove features at any time.
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account. Accounts have one of three roles per business — Owner, Manager, or Employee — with different permissions. You must be at least 16 years old to use the Service.
You retain ownership of all content and data you submit (schedules, employee records, availability, etc.). You grant us a limited license to host, process, and display this content solely to operate and improve the Service. You are responsible for the legality of the data you upload, including compliance with employment, labor, and privacy laws applicable to your business.
Do not: use the Service to break the law, infringe rights, or harass anyone; attempt to access accounts or data that are not yours; reverse engineer, scrape, or interfere with the Service; resell the Service without our written consent; or upload malware or content you do not have rights to.
Core scheduling features are free with no caps on employees, locations, or history. Paid plans cover integrations, custom work, and support. Paid fees are billed in advance, are non-refundable except where required by law, and may change on 30 days' notice.
You may close your account at any time. We may suspend or terminate access if you breach these terms or if we discontinue the Service. On termination, your right to use the Service ends; we may delete your data after a reasonable retention period.
The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation. Compliance warnings in the Service are advisory only and do not constitute legal advice; you are responsible for compliance with applicable laws.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) US$100.
You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these terms or any law.
We may update these terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Florida, and you consent to that jurisdiction.
